Amy M. Byrne

Amy Byrne is an MSBA Certified Real Property Law Specialist and an associate at Hellmuth & Johnson. She provides advisement on commercial and residential real estate matters such as purchase and sales, leasing, community associations governance, and lien foreclosure. Amy dedicates her practice to providing the most up to date legal advice through her regular attendance at continuing learning seminars. She understands the law has multiple layers that require a careful understanding of municipal, state and federal law. With this understanding, Amy provides practical advice to real estate questions that she tailors to each legal need.

Amy is an all-round real estate attorney that enjoys working with small to large business owners, Associations and individuals. Often times, the type of regulatory law that applies will be different depending on the type of client she is working with. Amy has experience working with a variety of clients and has the confidence necessary to identify legal issues at the outset.

Amy achieved board certification as a Real Property Law Specialist based on her substantial involvement in the field of real estate law, continuing legal education, adherence to a high standard of professional responsibility and ethical conduct, attorney references, and written examination. Fewer than 3% of licensed attorneys in Minnesota are certified as specialists in their field by the Minnesota State Bar Association.

Clients appreciate that Amy has experience in a variety of real estate matters. While away from the office, Amy invests in real estate and often considers her hand-on experiences to provide a practical view of the law. She understands the business of real estate and provides workable solutions to real life problems.

EXPERIENCE

  • Advised buyer on the purchase of property through a contract-for-deed that protected the buyer’s financial investment and mitigated liability throughout the payment period.
  • Represented Seller on the execution of its purchase agreement and revised multiple common interest community documents to accurately reflect title prior to the sale of the resort.
  • Advised franchise owner on commercial lease and negotiated with the landlord to incorporate terms favorable to the franchise owner that revised the landlord’s standard multi-tenant lease form.
  • Representation of pop-up shop tenant at its city council meeting and acquired necessary licensure pursuant to city code.
  • Representation of multiple resort timeshare owners pursuant to agreement to deed back ownership to the Association and negotiated protections for sellers during the deed execution.
  • Representation of tenant at its city council meeting and acquired necessary licensure in compliance with city code.
