Daniel J. Sathre

Daniel Sathre is a seasoned attorney with more than 15 years of diverse corporate, complex litigation and in-house/general counsel experience. His practice at Hellmuth & Johnson focuses primarily on construction & lien law, construction defects and warranties, and business litigation.

Before joining Hellmuth & Johnson, Daniel’s experience included representation of a diverse range of commercial clients in a variety of legal matters ranging from construction and lien law, general corporate representation, commercial contract negotiation and drafting, internal/corporate governance, shareholder disputes, commercial transactions, pre-litigation dispute resolution and complex commercial litigation.

On the corporate side, Daniel has counseled and advised closely held companies on a diverse range of issues including contract negotiation and drafting, entity formation, drafting of corporate charters and bylaws, general corporate representation, risk mitigation, legal and regulatory compliance, corporate governance, and shareholder disputes, among many others. His broad experience in these matters resulted in a selection to the Board of Directors and to serve as Chief Legal Counsel for a closely held owner/developer of a bulk green hydrogen manufacturing project in the Southwest United States. Daniel has particularly extensive experience in reviewing and negotiating power supply contracts.

On the litigation side, Daniel has served as both lead and managing counsel in hundreds of complex commercial litigation matters around the United States on behalf of large financial institutions, contractors, insurers, closely-held and publicly-traded businesses and many others, including some of the largest financial institutions and commercial equipment lessors in the United States. His broad commercial litigation experience has resulted in expertise in multiple specialties, including financial services law and litigation, mortgage loan servicing defense, construction defect litigation, mechanic’s liens and payment bond claims, commercial and residential real estate litigation, creditor’s remedies, and insurance coverage litigation.  His work on behalf of his clients resulted in recognition as a Minnesota Super Lawyers “Rising Star” for eight consecutive years.

Outside of the office, Daniel is a proud “hockey and dance dad,” as well as an avid hiker, cyclist, and former national champion softball player.

EXPERIENCE

  • Won summary judgment on behalf of a Minnesota-licensed design professional dismissing professional malpractice claims based upon statute of limitations grounds and a lack of equitable tolling based upon fraud.
  • Secured a favorable cash settlement from a property insurer who had previously maintained a position of zero liability resulting from straight line wind damage to an industrial complex resulting in six-figure losses.
  • Successfully defended against Plaintiff’s summary judgment motion and negotiated a favorable pre-trial settlement on behalf of a Pennsylvania IT company which refused to pay a seven-figure e-discovery bill due to Plaintiff’s breach of contract and failure to effectively render contractual e-discovery services.
  • Obtained summary judgment in the amount of over $2.5 million in favor of a large national title insurance company against multiple defendants under the civil Federal Racketeer Influenced and Corrupt Organizations Act (RICO) statute arising from a sophisticated mortgage fraud scheme.
  • Won summary judgment and a subsequent appeal on behalf of one of the largest non-bank mortgage loan servicers in the United States which resulted in dismissal of over half a dozen borrower counterclaims based upon theories of breach of contract, fraud and other torts arising out of alleged wrongful foreclosure and illegal servicing practices.
  • Won a Wisconsin court trial as lead trial counsel on behalf of both a large international bank and mortgage loan servicer which included a foreclosure judgment and a dismissal of Defendant’s fraud counterclaim from the bench.
  • Successfully defended a closely-held Minnesota business accused of fraud in the inducement and breach of a multi-million dollar asset purchase agreement by persuading the trial court to dismiss the claims on summary judgment.
  • Negotiated a $200,000 settlement on the first scheduled day of trial in favor of a national logistics provider after winning partial summary judgment and successfully disqualifying the defendant insurance company’s expert witness.
  • Obtained summary judgment in Federal court in favor of a large mortgage loan servicer dismissing Borrower’s claims under the Truth in Lending Act seeking to rescind his mortgage for alleged TILA violations.
  • Obtained summary judgment in Federal court dismissing Borrower’s affirmative claims for alleged violations of the Fair Debt Collection Practices Act, Minnesota’s Homeowner Bill of Rights, dual-tracking and foreclosure statutes which Borrower alleged amounted to an illegal taking of his home, resulting in substantial economic damages and severe emotional distress.
  • Obtained an appellate victory in the Wisconsin Court of Appeals reversing the district court’s interpretation of the decedent’s will and awarding his client a substantially increased share of the decedent’s estate.
  • Represented Neal Schon, guitarist for famous rock band Journey, in a defamation action in United States Federal District Court against his former mother-in-law.
