How VW Cheated Emissions Tests:

In September 2015 the United States Environmental Protection Agency ordered Volkswagen to recall nearly one-half million vehicles sold in the US from 2009 to the present with 2.0 liter TDI “clean diesel” engines because Volkswagen installed software which misled regulators by changing the vehicles’ emissions during official testing. The software was designed to detect when the cars were undergoing official emissions testing and only then did the cars turn on their full emissions control systems to satisfy official standards.  These control systems are turned off during normal driving to achieve Volkswagen’s advertised fuel economy and performance standards, but at the same time emitting up to 40 times the regulatory standard for nitrogen oxides.

Audi A3 (model years 2010-2015)

Beetle (model years 2012-2015)

Beetle Convertible (model years 2012-2015)

Golf (model years 2010-2015)

Golf SportWagen (model year 2015)

Jetta (model years 2009-2015)

Jetta Sportwagen (model years 2009-2014)

Passat (model years 2012-2015)

Consumers bought the vehicles at issue because they believed the vehicles were environmentally friendly and had great performance and fuel economy.  Now consumers are left with vehicles which they cannot sell due to substantial diminished value.  Some consumers have even paid previously for repairs to their vehicles which resulted from the defects.  While Volkswagen has not identified a “fix,”  the likely result is that any such fix will materially reduce performance and fuel economy.
