Joel A. Hilgendorf

Joel Hilgendorf is a partner in the real estate practice group of Hellmuth & Johnson. He is certified by the Minnesota State Bar Association as a Real Property Law Specialist. Joel counsels banks, businesses, individuals, and community associations in all legal issues related to real estate, including sale, purchase, leasing, and financing of residential and commercial property.

EXPERIENCE

Real Estate:

  • Represent all parties to transactions involving real estate (i.e. sellers, buyers, brokers, agents, landlords, investors, lenders and title companies).
  • Represent all parties in litigation, arbitration, and other disputes involving real estate (buyer-seller disputes; purchase agreement disputes; title defects; boundary disputes; easements; ownership disputes; partitions; leasing disputes; contract for deed cancellations).

Banking and Finance:

  • Represent financial institutions in commercial lending and credit transactions, drafting loan documentation for commercial real estate, construction, corporate business asset, and all other types secured and unsecured commercial loans.
  • Represent financial institutions and creditors in mortgage foreclosures, UCC proceedings, litigation, lawsuits, receiverships, workouts, forbearance, guaranty enforcement, garnishments, levies, judgments, and all collection related matters.

Homeowner Associations:

  • Serve as general counsel to a large number of community associations in all legal matters (i.e. governing document interpretation and amendment; covenant enforcement; assessment collection; use restrictions; banking and project funding; litigation; corporate legal advice; and general representation).
