Biography: Nancy T. Polomis

Nancy brings considerable insight to all stages of community association development and functioning, including entity formation, the creation and interpretation of covenants and bylaws, and collections. Her clients include local and national builders and developers (both residential and commercial) and numerous homeowners associations throughout Minnesota.

Nancy’s many long-term relationships with community associations testify to the quality of her work, and her experience extends across the real estate spectrum. She has in-depth understanding of the real estate market, which enables her to provide direct and proactive counsel to builders, developers, individuals, and entities involved in real estate transactions, as well as to condominium and townhouse associations.

Nancy’s clients include:

  • Local and national builders and developers (both residential and commercial) in various capacities:
    • Creation of new community associations (including drafting of covenants and corporate documents)
    • Interpretation of existing associations’ governing documents and their impact on potential further land development
    • Review, revise and negotiate terms of development agreements and related easements, etc.
  • Numerous homeowners associations throughout Minnesota:
    • Interpretation of governing documents
    • Amendment/re-writing of governing documents
    • Enforcement of governing documents
    • Collection of unpaid association assessments (dues)

Clients rely on Nancy for clear, concise information, a talent for explaining complex legal matters in everyday language, and her ability to anticipate potential issues. Associations and builders in the initial development stages particularly value these qualities.

Moreover, when particularly vexing issues arise, clients count on Nancy for the collective wisdom of her fellow practice members. “We truly function as a team,” she explains. “That’s important because it enables practice members to have particular expertise in our niche practice area. So, where my knowledge may trail off, one of my colleagues will likely have the answer. That kind of breadth and depth of knowledge is a unique feature of our practice — and a formidable asset for our clients.”

She is licensed to practice in the Minnesota state courts.

Few firms in Minnesota approach the expertise of Hellmuth & Johnson’s community association practice, and the number of attorneys with my level of experience on both the builder and association sides of the equation is smaller still.
